Résumé des faits
The defendant promoted the output of several Brazilian women for the purpose of sexual exploitation in Europe.
In June 1999, the defendant sent the victims S.P.J. and C.E. to Benicaci-Castellon, Spain, where they would work as prostitutes at the club known as Capricho. The defendant provided them with about U$400,00, tickets and housing. In 2002, she sent the victim P.F.T. to Spain for the same purpose of sexual exploitation. The defendant was also responsible for organizing the trip, paying for the tickets and housing.
According to P.F.T.'s testimony, the defendant had not informed her about the conditions of the work in Spain. The victim also said that the expenses for the trip were later paid back to the defendant from her earnings as a prostitute in the club BACOS, where she was forced to work until she could pay for the whole expenses.

The Judge set the base penalty for the crime of international trafficking in person for the purpose of sexual exploitation, in the terms of the article 231 of the Penal Code, at the legal minimum of 3 (three) years of imprisonment. Recognizing the material conquest of the offenses, in accordance to the article 69 of the Penal Code, the defendant was sentenced to 6 (six) years of imprisonment, in semi-open regime.
The defendant appealed against the First Instance decision, postulating her acquittal for the absence of evidence, arguing that the documental and testimonial proofs were founded in reports collected only in the investigative phase, not subject to contradictory.
The Court considered that the documental and testimonial evidence, all clearly defined in the sentence, was strong enough to characterize the materiality and authorship of the criminal offense.
Although the prosecution witnesses weren´t located to be heard in court, being heard only in the inquisitorial stage, their statements have resonance in the others proofs collected. Therefore, the sentence of First Instance is based on conviction elements extracted from the whole evidence, not only proofs of the inquisitorial phase.
In the present case, the anonymous complaint, the investigation hold by the Federal Police, the documents (between them, two passports in the name of the defendant; tickets to Spain; and, phone bills with many calls to Spain) and photos (thirty-six photos of naked women poising in a sensual way) seized in the defendant´s residence were all gathered during the inquisitorial phase. However, the Court noted that its repetition during the judicial phase, would not be viable.
Thus, once the materiality and authorship had been proven, the Court denied the criminal appeal.
