In February 2006, A.M.M.T, 14 years old girl, was recruited by Lito Manalo to work in Manila as an entertainer. A.M.M.T. was very much afraid of the accused. The victim and the accused boarded the boat on their way to Manila. When the victim’s parents found out that their daughter was on board of the boat without their consent, the victim’s mother reported it to the police. The Coastguard authority looked for the victim and they found her in the company of the accused.

The accused was tried in absentia as he had managed to escape from detention using a forged release order. The Court gave the accused opportunity to defend himself by sending him the last notice. The accused did not appear to the Court, thus the case was considered without any defense evidence.
The employment of fear and intimidation by the accused on the victim was shown by the fear, shock and confusion displayed by the victim when she was rescued by Coastguard officers.
