UNODC ROEA seeks to recruit Consultants for:

 

1. Consultancy on development of a National Bail Policy Framework and Guidelines for the Republic of Kenya

The purpose of the assignment is to develop a National Bail Policy Framework for Kenya. The formulation of a National Bail Policy will necessarily involve the participation of key stakeholders in the criminal justice system, including but not limited to the National Police Service, the Law Society of Kenya, the Directorate of Public Prosecutions, the Judiciary of Kenya, the Kenya Prison Services and local and international civil society actors. A multi-agency approach strategy will be imperative in building the capacity of the criminal justice agencies to offer an effective bail system.

2. Consultancy on development of a Sentencing Policy and Guidelines for Magistrates and Judges in Kenya

The purpose of the assignment is two-fold:

i) To develop a National Sentencing Policy Framework, defining the role of Kenya's justice institutions in formulation, implementation and monitoring of Sentencing Guidelines and recommending, if necessary, establishment of the relevant institution entrusted with the functions mentioned above. The Policy Framework should also indicate Kenya's vision of further actions, reflecting the purposes of sentencing [1] such as the punishment of offenders , the reduction of crime (including its reduction by deterrence), the reform and rehabilitation of offenders , the protection of the public , and the making of reparation by offenders to persons affected by their offences .

ii) To develop draft Sentencing Guidelines for the most significant offences sentenced by Magistrates and Judges in line with relevant Kenya legislation, the 2010 Constitution and international standards. The Sentencing Guidelines should provide guidance on general sentencing issues and principles, allowing Judges and Magistrates in various Courts to be consistent in their approach to sentencing. The Guidelines should also provide guidance on factors Magistrates and Judges should take into account regarding severity of the sentence.
