INTERNATIONAL COOPERATION IN CRIMINAL MATTERS :

A KEY TOOL IN THE FIGHT AGAINST TERRORISM

In today's context of globalization, terrorism knows no borders. Criminals carry out their illicit activities by moving from one state to another or operating on several national territories. As a result, in an increasingly interdependent world, no country alone can deal effectively with terrorism. Therefore, cooperation between states to prevent and suppress acts of terrorism today is crucial. The ability of states to provide prompt and effective assistance to each other is no longer meerely desirable but an absolute necessity in order to effectively address the terrorist threat.

The United Nations Organization and the International Criminal Police Organization - INTERPOL are at the forefront of  international action against terrorism. Therefore, they have joined forces to provide Member States with technical assistance for strengthening police and judicial cooperation against terrorism, in particular by training law enforcement and criminal justice officers in the implementation of the universal legal instruments against terrorism.

This training will take the form of an online course, conducted in French, and developed by the United Nations Office on Drugs and Crime (UNODC) and INTERPOL, in cooperation with DiploFoundation. the course aims to strengthen this cooperation in combatting terrorism by developing the knowledge and skills of practitioners for an effective use of the international cooperation mechanisms envisaged in the 16 treaties adopted within the UN system between 1963 and 2005, and a number of binding resolutions of the Security Council.

To achieve this aim, the course examines the range of mechanisms and tools for cooperation following the different stages of a criminal case. The course:

• introduces the United Nations and INTERPOL institutional frameworks for action against terrorism;
• familiarizes participants with the requirements of universal legal regime against terrorism and the measures to prevent acts of terrorism ;
• provides a didactic and dynamic analysis of the fundamental mechanisms of interstate cooperation in criminal matters in the fight against terrorism, particularly the exchange of information, mutual legal assistance and extradition ;
• develops specialized expertise for the concrete and effective use of the main legal tools for cooperation ;
• raises awareness of the work of the United Nations and INTERPOL on counter-terrorism, international standards and norms, regional arrangements and national obligations in the field of counter-terrorism legislation.

Methodology

The course will be conducted entirely online and in French, over a period of 6 weeks. Reading materials and tools for online interaction will be provided to the participants each week through an online classroom. Participants will add questions, comments, and references in the form of hypertext entries which will be answered by lecturers and other participants, creating interaction based on the text. Participants will also complete additional online activities. At the end of the week, participants and lecturers will meet online in a chat room to discuss the week's topic. Thus, the course will be based on a collaborative approach to learning, with a high level of interaction.

There will be no formal assessment during the course. However, participants will receive individual feedback and guidance on work they submit. Each unit will have several activities intended to serve as study aid/self-assessment mechanisms. Furthermore, the final unit will introduce an individual assignment that will require independent work.

The course is delivered by staff members of the Terrorism Prevention Branch of the UNODC and INTERPOL  experts possessing experience in criminal justice and police issues and extensive work experience in the provision of legal advisory services and technical assistance worldwide.

The course will be offered free of charge as part of a capacity-building initiative on the part of UNODC and INTERPOL.

Selected applicants will receive a detailed course syllabus before the start date.

Who should apply ?

Persons involved in international cooperation in criminal matters, in particular extradition and mutual legal assistance. Priority will be given to applicants from developing countries.

Requirements

Applicants should :

• hold a university degree in Law, preferably with specialization in international and/or criminal law issues;
• have at least three years work experience as practitioner in the area of international cooperation in criminal matters (justice,police);
• have sufficient ability in French to undertake postgraduate level studies;
• have unrestricted access to the Internet using Firefox or Internet Explorer web browsers;
• be ready to commit a minimum of 6 hours per week to studies for the duration of the course.

OUTIL CLE DE LA LUTTE CONTRE LE TERRORISME

Dans le contexte actuel de la mondialisation, le terrorisme ne connait plus de frontières. Les criminels mènent leurs activités illicites en se déplaçant d'un Etat à l'autre ou en opérant sur plusieurs territoires nationaux. Dès lors, dans un monde de plus en plus interdépendant, aucun pays ne peut à lui seul s'attaquer efficacement au terrorisme. C'est pourquoi la coopération entre États en matière de prévention et de répression des actes de terrorisme revêt aujourd'hui une importance cruciale. La capacité des États à s'entraider rapidement et efficacement ne constitue plus une option mais une nécessité absolue s'ils souhaitent réellement s'attaquer aux menaces terroristes.

L'Organisation des Nations Unies et l'Organisation Internationale de Police Criminelle - INTERPOL, principales organisations mondiales impliquées dans l'action internationale contre le terrorisme, ont uni leurs efforts en vue de fournir aux Etats membres l'assistance technique nécessaire au renforcement de la coopération policière et judiciaire internationale contre le terrorisme. Cette assistance se traduit notamment par la formation des personnels des services de police et de justice pénale à l'application des instruments juridiques universels de lutte contre le terrorisme et à la mise en œuvre concrète et efficace des mécanismes de coopération.

Cette nouvelle formation en ligne, développée en français par l'Office des Nations Unies contre la drogue et le crime (UNODC) et par INTERPOL, en collaboration avec DiploFoundation, a pour but de renforcer cette coopération en développant les compétences et les connaissances des praticiens afin d'encourager et de faciliter l'utilisation des mécanismes de la coopération internationale envisagés dans les 16 traités adoptés par le système des Nations Unies entre 1963 et 2005 ainsi que dans un certain nombre de résolutions juridiquement contraignantes du Conseil de Sécurité.

Afin d'atteindre cet objectif, la formation adopte une approche didactique consistant à examiner et à approfondir l'ensemble des mécanismes et des outils de coopération existants selon les différents stades de la résolution d'une affaire. Ce cours :

• introduit le cadre institutionnel d'action contre le terrorisme de l'ONU et d'INTERPOL;
• familiarise les participants avec les exigences du régime juridique universel contre le terrorismeet avec les mesures destinées à prévenir les actes de terrorisme ;
• offre une étude didactique et dynamique des mécanismes fondamentaux de la coopération pénale interétatique en matière de lutte contre le terrorisme, en particulier de l'échange d'information, de l'entraide judiciaire et de l'extradition ;
• développe une expertise spécialisée pour une mise en application concrète et effective des principaux outils juridiques de coopération ;
• sensibilise les participants sur le travail de l'ONU et d'INTERPOL dans la lutte contre le terrorisme, sur les normes et les standards internationaux, les accords régionaux et les obligations nationales en matière de législation et de coopération contre le terrorisme.

Méthodologie

La formation se déroulera entièrement en ligne sur une période de 6 semaines. Elle sera composée de 5 modules. Des documents à étudier et des outils interactifs seront fournis aux participants chaque semaine par le biais d'une "salle de classe" en ligne. Les participants y ajouteront des questions, des commentaires et des références sous la forme d'annotations hypertextes, auxquelles les chargés de cours et les autres participants répondront, créant ainsi une interaction basée sur le texte. Les participants devront également réaliser d'autres activités en ligne. A la fin de chaque semaine, tous les intervenants, participants et chargés de cours, se retrouveront sur un espace de discussion en ligne pour discuter du sujet abordé durant la semaine. La formation sera ainsi basée sur un apprentissage en collaboration, avec un degré élevé d'interaction.

Il n'y aura aucune évaluation officielle pendant la formation. Cependant, les participants recevront un compte rendu et des conseils individuels sur le travail qu'ils remettront. Chaque module comprendra diverses activités qui permettront à chacun de faire une auto-évaluation. De plus, le dernier module exigera la réalisation d'un exercice final individuel impliquant un travail indépendant.

La formation sera dispensée en français par les experts du Service de la prévention du terrorisme de l'UNODC ainsi que par les experts d'INTERPOL, possédant une longue expérience professionnelle en matière de police et de justice pénale notamment dans le domaine du conseil juridique et de l'assistance technique à l'échelle mondiale.

Qui peut postuler ?

Les personnes qui sont impliquées dans le domaine de la coopération internationale en matière pénale, en particulier l'extradition et l'entraide judiciaire. La priorité sera donnée aux candidats des pays en développement.

Conditions

Les candidats à la formation doivent satisfaire aux critères de sélection suivants :

• Etre titulaire d'un diplôme universitaire en droit, de préférence spécialisé en droit international et/ou pénal;
• Justifier d'au moins 3 ans d'expérience professionnelle dans le domaine de la coopération internationale en matière pénale (justice, police);
• Maîtriser suffisamment le français pour suivre des cours d'un niveau élevé;
• Disposer d'un accès illimité à une connexion Internet utilisant les navigateurs Firefox ou Internet Explorer;
• Etre disponible au minimum 6h par semaine pendant toute la durée de la formation.
