Since 2003, a number of NPS have been added to the list of controlled substances contained in the Law 167/1998 (as amended) Sb on addictive substances and amending certain other acts, with lists of individual substances in the appended tables. In 2003, PMMA was added (See Collection of laws 223/2003; Zákon č. 223/2003 Sb., kterým se mění zákon č. 167/1998 Sb., o návykových látkách a o změně některých dalších zákonů, ve znění pozdějších předpisů); in April 2011, several NPS, including AM-2201, bk-PMA, bk-PMMA, Bromo-Dragonfly, Butylon, 2C-T-7, CP-47,497, CRA-13, DBZP, DOC, DOI, a number of JWH- compounds, mCPP, 4-MEC, TFMPP, etc were added to the list (See Zákon č. 106/2011 Sb., kterým se mění zákon č. 167/1998 Sb., o návykových látkách a o změně některých dalších zákonů, ve znění pozdějších předpisů).

On 3 September 2025, the prime minister approved in decision 644/2025 to amend Act No. 321/2024 Coll. on addictive substances to enter into force which places kratom (Mitragyna speciosa) and its extracts on the new list of psychomodulatory substances subject to regulated sale. Until this decision, kratom was not under national control and was accessible in the country. The regulation now permits sales of kratom and its extracts in licensed specialty shops to adults, restricts online sales to physical shops, bans vending machine sales and advertising, and requires consumer information on composition and dosage. Businesses must obtain licenses, and the products are subject to inspection.
