Decree No 146/2010, June 16 2010 amending the list of controlled substances contained in Decree 309/1990 “Consolidation of the laws governing drugs and psychotropic substances, the prevention, treatment and rehabilitation of drug addicts”

Since 2010, NPS have been added to the list of controlled substances contained in the main piece of drug control legislation: Law nº 162, 26 June 1990 approved by a presidential decree (DPR) nº 309 of October 1990 "Consolidation of the laws governing drugs and psychotropic substances, the prevention, treatment and rehabilitation of drug addicts", known as the DPR 309. Mephedrone, JWH-018 and JWH-073 were added to Table I of the list of controlled substances in 2010, Decree No 146/2010; MDPV, JWH-250, JWH-122 and analogues of the structure resulting from 3-phenylacetylindole or from 3-(1-Naphthoyl)indole were added in 2011 (see G.U. Serie Generale, n. 112 del 16 maggio 2011); butylone, certain analogues derived from cathinone, AM-694 and analogues of the structure resulting from 3-benzoylindole were also added in 2011 (see G.U. Serie Generale, n. 3 del 04 gennaio 2012; 4-MA, CP 47, 497, CP-47.497 homologue C8, 4-FA/PFA and MDAI were added in 2012 (see G.U. Serie Generale, n. 264 del 12 novembre 2012) and 6-APB, 5-APB, 6-APDB and 5-ADPB were added in 2013 (see G.U. Serie Generale, n. 158 del 08 luglio 2013). In January 2015 (see G.U. Serie Generale, n. 22 del 28 gennaio 2015) Etizolam was added to the List IV of the Presidential Decree of 9 October 1990, n. 309. In February 2015 (see G.U. Serie Generale, n. 48 del 27 febbraio 2015) 3 NPS were added to the list of controlled substances included in Table I of the decree of the President of the Republic 9 October 1990 n. 309, as amended: 25I-NBOMe; AH-7921 and MT-45.
