Since 2008, a number of NPS have been included in the list of controlled substances contained in the Act of 29 July 2005 on "Counteracting Drug Addiction" (with further amendments), which is the main piece of drug legislation in the country. This Act contains the list of controlled substances in two appendices, one for narcotic drugs and the second for psychotropic substances. Between 2009 and 2011, 51 new psychoactive substances were put under control by amending the Act on counteracting drug addiction. Khat, JWH-018, kratom, salvia divinorum, BZP and ketamine were added in 2009 (see here); synthetic cannabinoids such as CP-compounds, HU-210, several JHW- compounds, PMMA and mephedrone were added in 2010 (see Act No. 10/06/2010, Dz.U. 2010 nr 143 poz. 962).
On July 13, 2026, a regulation was anounced amending the list of substances (Journal of Laws 2026, item 934), including updates to NEP, Δ8-THCP and Δ9-THCP-O.
