The Customs Act of 1962 has been used to control NPS in India. In 2007, restrictions on the import and export of ketamine were issued under the Customs Act (see D.G.F.T. notification no 67 (RE 2007)/2004-2009, dated: December 27, 2007). Previous to the inclusion of ketamine in the list of psychotropic substances of the Narcotic Drugs and Psychotropic Substances Act (NDPS) in 2011, the import and export of ketamine was controlled under the Customs Act since 27.12.2007. Accordingly, the export of ketamine is allowed subject to obtaining a ‘No Objection Certificate’ from the Narcotics Commissioner and any attempt to export it illegally is subject to confiscation under the Act.
