According to article 32 of the Law 23 December 1978, and related to the functions of hygene and public health, the Ministry of Health may issue ordinances of character contingible and urgent, on matters related to hygene and public health. This law was used to counter NPS in 2010. An example is provided by the Ordinance of 06 April 2010 (G.U. Serie Generale, n. 87 del 15 aprile 2010), that prohibited the manufacture, import, marketing, trade and use of products referred to as "n-Joy" and "spice".  According to the ordinance, "pending the acquisition of more 'complete information elements related to danger 'to public health of the substances JWH-018 and JWH-073 and the completion of the procedure for the their possible inclusion in the list of controlled drugs (Decree the President of the Republic n. 309 of 1990)" it prohibited the manufacture, import, marketing, trade, including through the sale via the Internet and the use of products called n-Joy and Spice, in different commercial presentations, containing the aforementioned substances. The ordinance also ordered the withdrawal of these products from the market, within 30 days from the publication of the order. The ordinance had a validy until these substances were included in the list of controlled substances or otherwise until 31 October 2010, i.e. 6 months).
