On 8 December 2021, UNODC through its Global Firearms Programme (GFP), has organized the second workshop in Kyiv, Ukraine, with members from the Prosecutor’s General Office of Ukraine, State Bureau of Investigation, Security Service of Ukraine and Ministry of Interior to review and complete the draft text of the methodological recommendations for investigating and prosecuting crimes under Articles 201, 263 and 263-1 of the Criminal Code of Ukraine.
The document was reviewed by Ukrainian criminal justice practitioners for the first time on 19 October 2021 during a workshop organized by UNODC GFP. In the following period, the Ukrainian criminal law experts Professor Mykola Khavronyuk and Associate Professor Ruslan Shekhavtsov have reviewed and incorporated in the text the recommendations shared by the Ukrainian prosecutors and law enforcement practitioners.
During the second workshop, the participants reviewed the additional parts of the document and made final recommendations for its improvement. The methodological recommendations for investigating and prosecution follow the format, practice, and traditions established within the Ukrainian legal community. They focus on the crimes of smuggling of firearms, illegal handling of firearms and illicit manufacture of firearms.

The document presents the characteristic of these crimes, identifies the circumstances that need to be established in the process of investigation, lists typical investigative situations and provides recommendations for actions. The guidelines take into consideration the United Nations Convention against Transnational Organized Crime and UN Firearms Protocol.
As a next step, UNODC GFP will submit the final draft version of the document to the Office of the Prosecutor General in Ukraine for review and subsequent adoption.
